1. Applicability
These terms and conditions apply to every offer from Cannabidiol Company and to every agreement between Cannabidiol Company and a consumer, unless otherwise agreed in writing. The conditions will be made available before or at the conclusion of the agreement.
Deviations are only valid if agreed in writing. Mandatory statutory consumer rights always take precedence over provisions in these terms and conditions.
2. Offer and agreement
The offer contains the most complete possible description of the products offered, prices and any additional costs. Obvious mistakes or errors do not bind Cannabidiol Company.
The agreement is concluded when the consumer accepts the offer and meets the conditions set. Cannabidiol Company confirms the order electronically. If an order cannot reasonably be fulfilled, the consumer will be informed and any payment received will be refunded.
3. Prices and payment
Prices are stated in euros and include VAT, unless expressly stated otherwise. Any shipping or payment costs will be shown before completing the order.
The current payment methods are listed in the checkout. The order can be processed as soon as payment or payment confirmation has been received. The consumer is obliged to immediately report any inaccuracies in payment or order details.
4. Delivery
Orders will be delivered to the address specified in the order, while supplies last. Mentioned shipping and delivery times are expectations, unless a fixed term has been expressly agreed.
If delivery is not possible or only partially possible, the consumer will be informed as soon as possible. In the event of termination due to non-delivery, amounts received for the non-delivered part will be refunded.
5. Cooling-off period and withdrawal
There is usually a cooling-off period of 14 days for an online consumer purchase. This period starts on the day after the product has been received by the consumer or a designated third party. For one order with several separately delivered products, the period starts after receipt of the last product.
The consumer may withdraw from the agreement within the cooling-off period without giving a reason. This can be done using the available online withdrawal option, via WhatsApp or with the statutory model withdrawal form. The product must be returned within 14 days of giving notice of withdrawal, unless otherwise agreed.
During the reflection period, the product and packaging must be handled with care. The product may only be handled to the extent necessary to determine its nature, characteristics and function. Depreciation due to continued use can be passed on.
6. Return costs and refunds following withdrawal
The direct costs of return are borne by the consumer, unless Cannabidiol Company has indicated otherwise. In the event of complete cancellation, the purchase price and the costs of the cheapest standard delivery offered will be refunded. Additional costs of a more expensive shipping method chosen will not be refunded.
Refund will take place within the statutory period and may be postponed until the product has been received or the consumer proves that it has been returned, whichever comes first. In principle, the same payment method is used as for the original payment.
7. Exceptions to the right of withdrawal
The right of withdrawal does not apply when a legal exception applies. This may include products made to specifications, products that spoil easily or have a limited shelf life, and sealed products that are not suitable for return for health or hygiene reasons if the seal is broken after delivery.
An exception will only be applied if the legal conditions are met and this has been clearly communicated in advance.
8. Conformity and warranty
The delivered product must comply with the agreement and reasonable requirements that the consumer may impose on the basis of the offer, product specifications and the law. A commercial warranty does not limit legal rights.
If a product is incorrect, damaged, incomplete or not in accordance with the agreement, please report this within a reasonable period of time after discovery. Cannabidiol Company assesses the complaint and, if the complaint is justified, provides an appropriate legal solution.
9. Use and liability
The consumer must use and store the product in accordance with its label, instructions and intended purpose. To the extent permitted by law, Cannabidiol Company is not liable for damage caused by incorrect or inappropriate use, improper storage or failure to follow clear product instructions.
Nothing in these terms and conditions excludes liability that may not be excluded under mandatory law.
10. Force majeure
In circumstances beyond Cannabidiol Company's reasonable control, obligations may be suspended as long as performance is reasonably impossible. Consider serious disruptions, transport problems, government measures, failure of necessary systems or shortcomings of carriers and suppliers that could not reasonably be prevented.
If performance becomes permanently impossible, both parties can terminate the agreement for the unexecuted part. Any amounts already paid for that portion will be refunded.
11. Retention of title
Delivered products remain the property of Cannabidiol Company until the consumer has paid all amounts due under the relevant agreement.
12. Complaints
A complaint can be submitted via WhatsApp. Describe the complaint in full and include the order number, product and batch number where applicable. Photos, videos and documents can be sent in the same conversation. Our support team is available on working days from 10:00 to 15:00 and responds within a reasonable time.
If a complaint cannot be resolved by mutual agreement, the consumer retains the legal options to submit the dispute to a competent authority or judge.
13. Governing Law
Dutch law applies to agreements with Cannabidiol Company. This choice of law does not deprive a consumer of the protection of mandatory provisions applicable under the law of the country of residence. Disputes will be submitted to the competent court according to the law.
14. Changes
The terms are subject to change. The version that was made available before or at the conclusion of the agreement applies to an order, unless a change results from the law.
